Asian Committee of Toy Industries (ACTI) is committed to protecting the privacy of Internet users. As part of the normal operation of this website, we collect information from you and we intend to give you as much control as possible over your personal information. Data Collection and Use
To maintain a high standard of service to you, personal data may be collected from you on a voluntary basis for some particular purposes or services as set out hereinbelow. Personal data including names, addresses, telephone numbers, email addresses etc. are used by us for the purposes stated on the respective screens, such as 1:

  • for processing applications for membership and/ or enrolment for training courses and activities
  • for providing services to promote business opportunities between Hong Kong and overseas, in particular supplying trade enquirers with contact and business information (with your prior written consent) 2

  • for distribution of publications, promotional and research materials
  • for marketing and promotion of ACTI's services

Personal Data information that you provide will not be used for other purposes without your written consent unless such use is permitted or required by law. If at any time you would like us to cease sending you any materials for marketing and promotion of ACTI, please contact our Data Privacy Officer and we will then ensure that you will not be included in future direct marketing promotions as statutorily required. 4

In general, personal data provided by you are retained for as long as the purposes for which such data were collected continue. Data are then destroyed unless their retention is required to satisfy legal or regulatory requirements. 5

ACTI takes necessary measures 6 to ensure that information pertaining to personal data that you provide in this website is stored in a secure environment and accessed only by authorised persons. ACTI however gives no warranty against hacking by third parties or any unauthorised access to the data by anyone or against any attack by computer viruses. 1. The list of purposes should be an exhaustive list so as to ensure that any Internet user being the subject of data ("the data subject") is explicitly informed of all the purposes for which the data are to be used on or before collecting the data in compliance with the Data Protection Principles 1(3)(b)(i)(A) and 5(C) of Schedule 1 to the Personal Data (Privacy) Ordinance (Cap. 486) ("the Ordinance").

2. According to s.33(2) of the Ordinance, a user of other's personal data ("data user") whose principal place of business is in Hong Kong or who collects, holds, processes or uses the personal data in Hong Kong shall not transfer personal data to a place outside Hong Kong unless, inter alia, (i) the place is one specified by the Privacy Commissioner for Personal data; or (ii) it has reasonable grounds for believing that there is in force in that place any law which is substantially similar to, or serve the same purposes as, the Ordinance; or (iii) the data subject has consented in writing to the transfer; or (iv) it has taken all reasonable precautions and exercised all due diligence to ensure that the data will not, in that place, be collected, held processed or used in any manner which, if that place were Hong Kong, would be a contravention of a requirement under the Ordinance. Therefore, Group 18 - Non-manufacturing I – Support Services for Industry may find it most convenient to simply secure the written consent of the data subject prior to its transfer of the data to an overseas party and obtain such a consent at the time of collecting the data.

3. Although personal data can be collected for statistical or research purpose, it is advisable that the results of the research are not to be made available in a form which identifies the data subject.

4. Under s.34 of the Ordinance, a data user who uses the data for direct marketing purposes shall on the first use of those data inform the data subject that the data user is required, without charge to the data subject, to cease to use those data if the data subject so requests.

5. Data Protection Principle 2(2) of Schedule 1 to the Ordinance provides that personal data shall not be kept longer than is necessary for the fulfillment of the purpose for which the data are or are to be used.

6. Please note that necessary measures to protect the data against unauthorized or accidental access or processing should take into account the following:-

  • the kind of data and the harm that could result if any of those things should occur;
  • the physical location where the data are stored;
  • any security measures incorporated (whether by automated means or otherwise) into any equipment in which the data are stored;
  • any measures taken for ensuring the integrity, prudence and competence of persons having access to the data; and
  • any measures taken for ensuring the secure transmission of the data.
